I am confused on how to make/file claims, both for placer and hard rock. Does each state have different rules? How do you check to see if an area is already claimed? Is there a book anyone can suggest that takes a newbie that really knows nothing on this and gives enough information so the newbie knows what to do from start to finish? Thanks for any help.

Well you don't really need to buy a book. The info is here on the website. You can also visit a blm field office and pick up the official how to stake a claim booklet. There is also a blm officer that is able to answer any questions you have.

How do you check to see if an area is already claimed?

Hi Davem!
This is the right question to ask first. Researching the status of the lands you wish to explore before digging or removing any rocks is important to keep yourself out of trouble. A great topic to start with is How Do I Avoid Claim Jumping? . There is a bunch of info on this site that can help to answer your questions. I have found that a CP Club Membership is also very helpful in understanding land research and mining laws/regulations. thumbsupsmileyanim.gif

There are some State Laws dealing with claims however most of the laws are nationwide. There is no book to take you from "start to finish". I have rock ID books, rock hounding books, maps and other publications but they don't say about how to make sure there is not a claim there. That's where this website tries to fill the void.
