2015 Maint Fee Increase For Claims

I've attached a copy of the letter I received recently regarding the Annual Maintenance Fee increase.
If you are a claim owner and haven't received this, please read it carefully.
The increase is only $15 and I don't have problem with that... the problem I have is that they implemented this and served notice fewer than two months prior to the filing deadline. They have every right to do this since nobody bothered to oppose it in the allotted time frame but their timing is suspicious... this close to the filing deadline.
Another thing I feel the need to address, and Dan agrees with me on this: They now offer a "convenient" online annual mining claim renewal service. Don't be fooled, this can leave your flanks exposed, so to speak.
Why? Because in the Federal court of law a notarized document that has been sent via Certified Mail carries much more weight than an online click payment. Very important. happy112.gif
Furthermore, I clicked on the online renewal option just to have a look. I entered the information it requested several times and each time it gave me the ol ""Error 404" message. Sweet baby Jesus... remind you of anything? Yes, Obamacare.
Needless to say, I don't recommend using their online renewal service... for a number of reasons. chin.gif
Fellow claim owners - if you filed and paid your $140 fees for 2015 prior to this change make sure you send them the additional $15 by the end of August or your Active Status will be in jeopardy. I'm sure they'll serve 30 day notice.... but still.

The big change is the $155 per 20 acres. It used to be just per claim all the way to 160 acres. I file the maintenance waiver every year so it doesn't bother me at all.

I don't know many folks who file that way anymore Leonard. I certainly won't, leaves the claim owner exposed to legal proof of maintenance performed if they ever get a boner for you or your claim.
Careful with that type of filing unless you are prepared to prove and quantify your maintenance.... and they can arguably set unknown value standards, it's a potential legal trap if they want it to be. Nobody in my Mining District files like that anymore. The $155 option is very good peace of mind.... one less thing they can bring to the table and legally harass you about if it comes down to it. The Maintenance Waiver is a loophole that can only work in their favor. Your only benefit to the Maintenance Waiver is a petty annual savings on the filing fees. A good few days of mining and my claim has paid its own Maintenance fees. Instead of them checking on my maintenance.... the shoe is on the other foot, they (NFS and/or BLM) are responsible for maintenance (that's their job) and I'm a damn good whip cracker. whip.gif

Leonard has been, and still is in good standing and has a good relationship with these agencies in Colorado and in Wyoming! but you are right, peace of mind is "priceless" !!!! any wacoenviromentalists bent on harassing or stireing up trouble for a claim owner can and has dumped "their" trash on legal claims and has defaced cliam signs and other cowardly signs of immaturity! takeing pictures of your claim /signs / marker posts with GPS locations noted will go a long way to showing these agencys that you (the claim owner) has been vigilant in doing what is required to do to maintain the claim , making it ezer to defend your assertation that you've done what has been required todo. takeing pictures and GPS locations of claim monuments and send / handing them to the approperate agency has always helped keeping a good working relationship with these agencys! PLUS they'll keep a eye out and question anyone on the claim that don't have written permission on them to be there! Ive personnaly seen this on the Arkansa River claims.

I don't want to spark a debate on the best method of filing, to each their own for sure. That could make a good thread on it's own. chin.gif
anyway.... all claim owners should be wary of using the "new online portal" for annual filing and payment of fees.... whichever method of filing is preferred.
You can't beat Notary + Certified Mail for evidence if/when needed. info_grin.gif order.gif

That 20 acres- that's just for a placer claim? I don't do any hard rock but if I ever did- does one claim cover the entire vein and its branches regardless of where it heads?

20 acres is for all claims......and no that does not mean it will "cover the entire vein and its branches regardless of where it heads".

Seeing that this is BLM, is it federal? Or, since it was addressed specifically to Colorado claim holders, is it now state-specific?

I just left the BLM today. Gave them my $10.00 each for 2 claims and good to go for another year. Been doing it for about 20 years now. It will cost me another $8.00 approximately for the county recorder though.
