Claim report info?

If 2018 fees haven't been paid wouldn't a claim be invalid now? Some claims have lapsed in this area I'm watching as far as I can tell but it still shows active on the report? I want to go prospect if it's open but I can't find anything saying it was renewed?

Also another question. If there is a lode claim in an area am I safe prospecting for placers without disturbing their operations or "trespassing"? I've heard of lode claims and placer claims overlapping but I'm not sure on the rules. I don't reckon I'd see anyone at all and I wouldn't have to dip my pan in plain sight, but is it a big deal anyway?

Not that I'm expecting to find much, just need to check them off the list if nothing there and if I don't need to search for lode claim maps at the county that would be awesome.

As far as I know the website is slow to update on the status of claims. It will be best to call them and ask


As far as I understand you can Prospect on the surface of a load claim but then again I am not a professional so do not take my word as fact.

I would wait and call the ones who are actually in charge and know the laws.

I don't believe you can prospect the surface of a lode claim without it being a trespass, and even if you found something within their claim boundaries you couldn't dig it anyway. I have seen where placer and lode claims do overlap with different deposits and with the way the lode claim lays out could cross a placer deposit yet they are mined by different people.

I'd just be in the drainages testing to see what's there but probably nothing. There were only lode ops on this certain mountain and not any placer ops nearby so if I stuck to testing the drainages I should be ok, plus they are all old non working mines anyway and no one around so I feel like I'd be fine. They all closed during the 50's or earlier.

Someone here will clear this up I'm pretty sure. There's much more info in these forum members than anyone I could call at the blm and it might just confuse them haha.

Two of the mines we're big ops and have been patented so that's easy to avoid and I wouldn't need to go that high up anyway. The other two or three I saw were also lodes and more current ones and aren't patented but I'd imagine they are up the hill from the creek like the other mines are. They were excavating polymetallic replacement veins from between limestone and igneous rock from what I can gather and the silica rich body heaved upwards underneath and exposed the veins. Im just thinking NUGGETS!
I haven't been there yet but just trying to cover my bases before I go.

The LR2000 can not be relied on to determine the location of a mining claim. For that you will need to obtain a copy of the original location notice, map and any amendments recorded at the County Recorder. LR2000 information can not be relied on to be timely or accurate. Boots on the ground are required to obtain the actual location determined by the monuments and stakes.

You can not prospect a claim you don't own without permission from the claim owner. It doesn't matter whether the claim is lode or placer the minerals within the location are the private property of the claim owner.

There is no circumstance where a valid placer claim can be located over a valid lode claim. A lode claim can be located over a placer claim once a valid lode discovery is made by either the owner of the preexisting placer claim or by another if invited by that placer claim owner to prospect the claim.

The lode over placer issue is covered in detail in Section 11 of the General Mining Act of 1872.

A very good place to start increasing your knowledge is the above mining law as well as the very important mining case Cole v Ralph. The Supreme Court explains just about every claim/adverse claim possibility as well as covering the real implications of allowing others to prospect your claim in Cole v Ralph

Thanks Clay! You cleared it up and that makes sense.

I need placer claim maps for some other areas close that I want to check anyway so I can get them all at Gunnison county. Hopefully they all filed a claim map to make it easy!

FYI my claim is on landmatters now I noticed. When I didn't see it there awhile back I mentioned it but maybe things were updating or the blm was having issues. It's all good!

I'll do the boots on the ground thing.
