Corp of Engineer Waterways, Dredging Allowed?

I am wondering about the rules or regs for dredging on waterways controlled by the Army Corp of Engineers. There are several here, including the Missouri River, and some smaller rivers and creeks who are under their control for flood control reasons. Does anyone have any links to the Corps rules or regs I can look at?

Once you get to their homepage, lok for NWP 19. (Nationwide Permit #19). It's a blanket permit for 4 inch and under dredges nationwide.

I've got it as a file, but too hard/long to post whole thing here.

I am very sorry Russ.....It was a public notice and I failed to realize that was you.

I really meant no harm, I actually found it on the USACE page and it was public disclosure. I am sorry, It was late and I don't even think I checked the name just the results of a search.

also, when youget a nationwide permit, they are only good for that site alone! you need to amend that permit to go to a different location or different creek! they get pretty snickety on this subject!

another thing about the C.O.E. they claim all navigatable waters in the usa and their backfills at highwater marks and all wetlands. even on private property!! if you read their section 404b, it conveys this!

if you would like to know more about this ,call the c.o.e in your area. they can do all of this over the fax line.even issuing the permit. or just simply a letter of authorization to work a area. its all in the paper work they will send you!

Just thought I would post this here also.
Had to call the Army Corps of Enigineers again today per the city of Idaho Springs request.
Terry will be sending me a statement in writing to the effect that they will not regulate our level of activity here in Colorado. huh.gif
Thought this would be an interesting tid bit seeing as how they are a federal entity. ;)
Or am I not perceiving the Army Corps of Engineers status correctly?
And how will this weigh against other states who seem to require the NWP 19?
:o huh.gif wacko.gif
Anyway, will be a good thing to have for future reference I would think.

that would be a nice document to have in your folder of permits,information, 1872 mining laws that everyone should have with them when they go out to a area. if someone questions you, youopen your folder and proceed to have the paper work neatly and in order. you would be suprised how much this simple little act of having your papers neatly in order would keep the gov. from bothering you any longer! its the people that dont have any papers or permits that they are really looking for.if your informed and know the law they have a hard time buffaloing you into moving on down the road! you cant bluf me when im holding a royal flush!

Here is a copy of the email I sent after talking with Terry on the phone, and the letter I got back.

What we would like to do is have several demonstrations (3-6) running in Clear Creek.
Our event will be held at the Argo Mine and Mill in Idaho Springs, June 25-27, 2004.
6th PM-T3S-R73W-Sec 36, Clear Creek County, Colorado.

This event is free to attend and being held as an educational demonstration of the modern day, environmentally sound, small scale equipment used today.
All the demonstration units (power sluices) to be used will be a 4" intake or less.
There will be no alterations to the creek bank nor the tailings piles located on the site.

We will also have vending and games etc during the three day period.
The patented claim owners at the Argo have generously allowed us to hold this event on their claim.
The claim stops at the midpoint of the creek so we will also take this oppurtunity to demonstrate that rafting and other casual uses can occur at the same time on the same part of the creek.
