Many gold/prospecting web sites have warnings that it is illegal to prospect on Boulder County property (USFS land is OK unless it is claimed). This is clearly stated on BoCo's Open Space web site. However, I can't find any reference to this on BoCo's Zoning, Land Use, Rules & Regulations, Ordinances or other county web site.

Does anybody know where this ruling is posted? Or is this a plot by the Peoples Republic of Boulder County to keep prospectors out.

well..... definitely a plot, but a legal one since they own the property.
My best educated guess would be the Boulder County Clerk/Recorder's office. I'm assuming that there "should" be a filed public record of this County ruling in their physical system.

Does their ban conflict with the mining rights laws? That seems illegal to me.

Not at all. The land is owned by the County. That means it's not public domain and not land owned by We The People. Ownership belongs to the County and they may regulate it as they wish, usually the will of the voting taxpayers within that County. No conspiracy, really. It's technically private property.

I disagree. Hickenlooper is a Dem but.... he is also a geologist. I don't agree with his gun bias but we don't entertain politics here on the forums unless they pertain to mining.
We are NO WHERE NEAR what California is and hopefully never will be. Colorado remains a very strong supportive mining state. All mining laws upheld and in abidance for the most part. We are fortunate to live here.

The City of Boulder also owns several mountain parks that were patented placer and lode claims. They certainly don't permit mining on their property as they own both the surface and mineral estates.

Maybe they need the open space for the next Starbucks or yoga studio. Hehe

True, Boulder County "public" land is private. Unfortunately I voted for Open Space. Never again. They are closing off a lot of it to public use. Darn it, I'm paying taxes for it and should be able to use it.

Also, they are buying property in neighboring Weld & Jefferson counties. The Open Space Nazis are buying a lot of patented claims too. It's a patchwork of private and county land up in the mountains. Thank God they can't buy USFS land, but I'm sure they'll try.

This county was founded on mining & agriculture. Not bicycles, joggers, kayaks, coffee shops, pot shops, new age flakes and libtards.

Well, the good news is that there are thousands of square miles outside of Boulder County that are worthy of prospecting. Not all Open Space areas are run by anti-prospecting cliques. Jeffco Open Space is a good example... they allow (regulated) recreational prospecting. Crusty and I will be taking advantage of that tomorrow on Clear Creek and you are welcome to join us. I wish Boulder County would allow prospecting within their Open Space boundaries, they certainly could.... but they likely never will based on the (ignorant) environmental sentiments that are constantly echoed through the land of hippy drum circles. They're one notch away from declaring themselves part of California and selling the whole County to the Nature Conservancy.
Sorry that last bit of rant was unnecessary, but I'm leaving it.
Keep your chin up, we all find lots of goodies way outside of Boulder County, where we can legally exercise our 'rights'.... and sometimes 'privileges' if working at recreational areas like Jeffco.
